1. Driving Record Fee
A Driving Records fee in the amount of $30.00 for the 3-year record, $32.00 for the 5-year record, or $35.00 for the 7-year or complete record will be charged to you. This fee includes all applicable sales tax.
Each record request is charged by the state so we cannot process a refund for inaccurate information. Each time an order is placed a new payment will be required. eDriving incurs a charge each time a record is processed and eDriving is unable to recover any fees collected by the state regardless of the results of the record processing. All required information must be provided by you when requesting the driving record. It is your sole responsibility to provide accurate and complete information to eDriving. Proper information includes, but is not limited to, first and last names, address, contact information, driver’s license number and signature. If complete information is not received correctly, eDriving will be unable to process your order and no refund will be granted. Any refund which may be issued will be full refund.
You may only order driving record for employment purpose. Anyone attempting to access driving records other than for their own employees or prospective employees may be subject to severe penalties under applicable federal and state law. Submitting a driver record request to eDriving authorizes eDriving to provide you with a copy of the current driver’s record. Driver record information is obtained directly from the state agency and/or third party provider. eDriving makes every effort to provide you with the most up to date and accurate information, but some portions of your driving record may be out of date or incorrect. eDriving nor its affiliated companies, officers, directors, employees, agents, information providers or suppliers attests to the accuracy, timeliness or reliability of the data on provided driver record and shall not be liable for any losses caused by reliance on the accuracy, timeliness or reliability of information contained therein.
4. Information Source and Accuracy
Information provided on the driving record is obtained from various state agencies and service bureaus. eDriving attempts to insure the accuracy of transmission and data, the reports are provided “as is”. eDriving nor its affiliated companies, officers, directors, employees, agents, information providers or suppliers in no way assumes liability for the accuracy and/or completeness of any information report provided on your driving record.
5. Privacy Statement
eDriving collects information from its users at several different points on the website. eDriving will not use or sell this information to promote products or services unrelated to this product or in ways different from what is disclosed in the Privacy Statement. By agreeing to these terms and conditions, you are agreeing to the collection, use and disclosure of your personal information as described in the Privacy Statement.
When submitting a request for your driving record through eDriving, you agree that you will indemnify and hold harmless eDriving, its affiliated companies and their officers, directors, employees and shareholders from any and all damages, fines, penalties or any other liabilities imposed by local, state or federal laws or regulations or claimed by any third party, including attorney’s fees, which result from or arise out of your providing your personal data or information, or your use of the driving records which are provided by eDriving.
7. Representations and Warranties
By using this website or our phone ordering system you agree to abide by all applicable local, state and federal laws with regard to the driving record you are ordering and you will not share this information with any third parties.
You further certify that the information you obtain from us will be used by you (and by any party to whom you furnish information) only for “permissible purposes” as defined in the Fair Credit Reporting Act (FCRA). Under Section 621 (a) (2) (A) of the FCRA – any person who violates any of the provisions of the FCRA may be liable for a civil penalty of not more than a two year jail sentence and $2,500 per violation. You agree not to use the data obtained through eDriving for any unlawful purposes, including but not limited to violations of state and federal employment laws and provisions applicable to the FCRA and you understand that our systems or those of the Department may experience occasional downtime due to maintenance, network connectivity or other issues.
