A new law to deter against distracted driving has come into effect in Ohio.<\/p>\n
Under House Bill 95, law enforcement officers no longer need to prove a driver is texting, but only that\u00a0a moving violation has occurred and the driver was distracted at the time.<\/p>\n
The law requires an enhanced financial penalty in addition to existing fines or alternatively the completion of\u00a0a distracted driver\u00a0course,\u00a0for\u00a0drivers who\u00a0commit a specific traffic\u00a0violation\u00a0while distracted. For example, a driver operating a vehicle outside marked lanes who is also engaging in a distracted behavior, will face an enhanced fine of up to $100 in addition to a fine for the lane violation. Other violations such as red light, stop sign, speeding, and other moving violations similarly would result in potentially higher fines.<\/p>\n
The Ohio Department of Public Safety\u00a0has created\u00a0a distracted driver course for\u00a0offenders\u00a0who\u00a0plead guilty\u00a0or are convicted\u00a0of\u00a0a specific traffic violation while distracted. The course\u00a0is available\u00a0in lieu of paying\u00a0the\u00a0enhanced court fine\u00a0of $100 or less, providing the\u00a0offender\u00a0pays the total amount of the fine established by the violation and\u00a0submits\u00a0written evidence of completion of the distracted\u00a0driver\u00a0course.<\/p>\n","protected":false},"excerpt":{"rendered":"
